1. General

These General Terms and Conditions apply to the sale and delivery of goods by KHAN E-Commerce GmbH through the online shop mykhan.eu. We deliver goods within Austria, Germany, Croatia, Czechia, Slovenia, Slovakia, Hungary, Poland and Italy. Billing addresses from the entire EU are accepted. For orders from other EU countries, please contact us by email.

By ticking the checkbox "I accept the Terms & Conditions" before placing the order, the buyer agrees to these General Terms and Conditions and is bound by them.

Our product range is non-binding. The order placed by a fully legally capable customer (persons aged 18 and over) constitutes an offer to conclude a purchase contract. The confirmation of receipt of the order subsequently sent by us pursuant to § 10(2) ECG does not yet constitute acceptance of the offer. The purchase contract is only concluded once we dispatch the ordered goods, by sending a second email as order confirmation, or by other acceptance of the customer's offer. All offers on our website are non-binding and only available while stocks last.

The contract, order and business language is German. The shop is also available in English.

2. Ordering Process, Order Correction, Order Cancellation

Once you have selected the desired product, you can add it to the shopping cart without obligation by clicking the "Add to Cart" button. You can view the contents of the shopping cart at any time by clicking the cart icon. You can remove products from the cart at any time by clicking the delete button.

To purchase the products in the cart, click the "Checkout" button. Please enter your details. For first-time orders, email verification via a code is required. Your data is transmitted in encrypted form. After entering your data and selecting the payment and delivery method, you will reach the order page via the "Place binding order" button, where you can review your entries once more. By clicking the "Place binding order" button, you complete the ordering process. You can correct your entries by using the browser's back button. The ordering process can be cancelled at any time by closing the browser.

3. Contract Language

The contract content, all other information, customer service, data information and complaint handling are offered in German and English.

4. Prices

Prices apply at the time of the order, inclusive of statutory VAT (20%), plus all shipping costs. They are visible in the shopping cart before conclusion of the contract and subsequently in the order confirmation sent to the customer. Should export or import duties become due during shipping, these are also borne by the customer (information available from your local customs office).

5. Right of Withdrawal

Consumers pursuant to the Austrian Consumer Protection Act (KSchG) have the right to withdraw from this contract within fourteen days without giving any reason. Returns are free of charge. You will receive a prepaid return label from us by email.

Note for business customers (B2B): The statutory right of withdrawal under the Austrian Consumer Protection Act (KSchG) applies exclusively to consumers. Business customers do not have a statutory right of withdrawal. However, we always strive to find a fair solution for our business customers as well — please contact us at office@khan.at.

6. Payment Methods

We accept the following payment methods:

  • Credit Card (Visa, Mastercard, American Express)
    Payment by credit card is charged at the time of the order. Data is transmitted via SSL encryption with a minimum 128-bit key and is therefore not accessible to unauthorised parties. Payment processing is handled by Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland).

No additional fees are charged for the use of the payment methods offered in the online shop.

7. Late Payment

In the event of late payment by the customer, we are entitled to charge the statutory default interest. The statutory default interest between consumers and businesses is 4 percentage points.

8. Retention of Title

We retain ownership of the delivered goods until receipt of all payments from the business relationship with the customer.

9. Delivery

Delivery is carried out by GLS and Austrian Post. The delivery time is 1–3 business days depending on the delivery country. Details on delivery times and shipping costs can be found on our Shipping & Delivery page.

We deliver within Austria, Germany, Croatia, Czechia, Slovenia, Slovakia, Hungary, Poland and Italy. Billing addresses from the entire EU are accepted. For orders from other EU countries, please contact us by email.

10. Risk of Loss During Delivery

The risk of loss or damage to the goods only passes to the consumer once the goods have been delivered to the consumer or to a third party designated by the consumer, other than the carrier. However, if the consumer has concluded the contract of carriage themselves without using a delivery option proposed by us, the risk passes upon handover of the goods to the carrier.

11. Warranty, Liability, Guarantee

Warranty is governed by statutory provisions. It is limited to the statutory period of 24 months from receipt of goods by the buyer or, in the case of services, from the completion of the service. In the case of justified complaints about defects, either free replacement or repair will be provided, for which a reasonable period must be allowed. If an exchange or repair is not feasible (impossible, too costly, unreasonable, delay, etc.), the buyer is entitled to a price reduction or, if the defect is not minor, rescission of the contract.

Our company is liable only for damages caused by intent or gross negligence. This does not apply to personal injury or in consumer transactions.

13. Storage of Contract

We store the contract text, which can be requested by you after completion of the ordering process. You can print the order data immediately after submission. To do so, you can use either the subsequent "Your Order" page or the "Receipt Confirmation" email.

15. Applicable Law, Jurisdiction

The contracting parties agree on the application of Austrian law. If the consumer has their domicile or habitual residence in Austria or is employed in Austria, legal action against them may only be brought before the court in whose district their domicile, habitual residence or place of employment is situated; this does not apply to legal disputes that have already arisen. The UN Convention on Contracts for the International Sale of Goods and all provisions relating to it are expressly excluded.

For contracts with businesses, our registered office is agreed as the place of jurisdiction.

18. Miscellaneous

Should individual provisions of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
